TERMS OF USE

These terms of use, including the Chubkins Privacy Policy located at https://chubkins.app/privacy, the Community Guidelines in Section 1 and the Chubkins Rewards Program Terms at the end of this page (hereinafter, the "Terms") govern your access to and use of the website https://chubkins.app/, any related Chubkins websites, webpages, smartphone applications (including the Chubkins app on the Apple App Store and Google Play) (the "Website"), desktop software, software as a service, and other Internet-based services operated by or under control of Petoskey Gaming Company, LLC, a Delaware Limited Liability Company ("Chubkins"), and associated Content (as defined below) (collectively, the "Service"), and constitute the entire, complete, and binding agreement between you and Chubkins with respect to the Service.

The offer of the Service to you is conditioned upon your acceptance of these Terms. Chubkins, owns and operates the Service. The terms "we", "us" and "our" also refer to Chubkins. The term "you" refers to the person visiting this Website or otherwise using the Service.

BY USING THE SERVICE FOR ANY PURPOSE, WITH OR WITHOUT AN ACCOUNT (AS DEFINED BELOW) AND FROM ANY DEVICE AND LOCATION, YOU REPRESENT THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS; YOU MEET THE ELIGIBILITY REQUIREMENTS DESCRIBED BELOW; AND, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS AS THEY APPEAR ON EACH RESPECTIVE DATE THAT YOU USE THE SERVICE.

IF YOU ARE ENTERING INTO THESE TERMS ON BEHALF OF A COMPANY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND THAT COMPANY TO THESE TERMS. IF YOU DO NOT ACCEPT ANY PART OF THESE TERMS, YOU ARE NOT ALLOWED TO ACCESS OR USE THE SERVICE IN ANY WAY.

1. Community Guidelines#

We built Chubkins for a safe, fun community. These Community Guidelines apply everywhere other players can see what you share, including chat, photos and gifts you send to a co-parent, your profile and profile picture, pet names, and leaderboards.

What's not allowed

• Harassment or bullying, including repeated messages someone doesn't want.
• Hate speech, slurs, or attacks on people because of their race, ethnicity, nationality, religion, sex, gender identity, sexual orientation, disability or age.
• Threats, or encouraging violence, self-harm or suicide.
• Sexual content or sexual messages. Anything that sexualizes or exploits a minor is banned outright, and we report it to the authorities.
• Asking other players for personal information, or sharing anyone's personal information without their permission, such as real names, addresses, phone numbers, social media accounts or photos.
• Scams, phishing or fraud, and offers to buy, sell or trade accounts, Diamonds or items for real money.
• Spam or advertising.
• Pretending to be someone else, including Chubkins staff.
• Cheating, or anything illegal.

Follow these Terms and the instructions of our moderators.

Reporting and blocking

You can report or block another player from the chat, or from their entry on a leaderboard. Blocking a player turns off your chat with them. Our team reviews every report. You can also report a problem to support@chubkins.app.

What happens if you break these rules

Depending on how serious it is, we may remove content, give you a warning, restrict your chat, or suspend or permanently ban your Account, with or without notice. We report child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as the law requires, and we may report other illegal activity to the authorities. We may investigate suspected violations and cooperate with lawful requests from authorities or service providers, including sharing account and technical information as permitted by law.

Appeals

If you think we made a mistake, email support@chubkins.app within 30 days and include your Share Code or the email, Google or Apple account you sign in with. We'll review it and tell you the outcome. If someone is in immediate danger, contact your local emergency services.

2. WHO MAY USE THE SERVICE#

2.1 Age Requirement#

The Service is not intended for persons under 16 years of age. You must be at least 18 years of age, or between 16 and 18 years of age with parental consent, to use the Service. No one under the age of 16, or under the age of 18 without parental consent, may use the Service or otherwise provide any information to or on the Service.

If you are under 18, or under the age of majority where you live, a parent or legal guardian must agree to these Terms for you. By letting you use the Service, your parent or guardian accepts these Terms and is responsible for your use of the Service, including any purchases.

You must be at least 18, or the age of majority where you live if that is higher, to redeem Diamonds for gift cards. See the Rewards Program Terms at the end of this page.

Where the law requires it, we may rely on age and parental-consent information from the Apple App Store or Google Play, and we may limit features, such as purchases or chat, until that consent is given.

Chubkins does not knowingly collect information from children under 16 or allow them to create an Account (as defined below). If you are under the age of 16, or under the age of 18 without parental consent, do not use or provide any information on the Service.

If we learn that we have inadvertently collected or received personal information from a person under the age of 16, or any unauthorized minor under 18 years of age, we will delete that information from our records. If you believe we might have any information from or about a person under 16, or any unauthorized minor under 18 years of age, please contact us at privacy@chubkins.app.

2.2 Note to Parents and Guardians#

Because it is difficult for us to verify a person's age online, it is entirely YOUR responsibility to supervise your child's online activities at all times. Parental control tools like filtering software and hardware are commercially available to help you limit a child's access to potentially harmful material on the Internet. If you discover that your child or any other minor has obtained an Account on the Service without a parent or guardian approval, please contact us immediately via email at privacy@chubkins.app.

3. LOCATION; CHANGES; DURATION#

3.1 Where Chubkins Is Available#

Chubkins is offered in most countries, but not all. We don't offer it in some countries for legal or business reasons, including countries and regions subject to comprehensive sanctions. Some features, including redemption of Diamonds for gift cards, aren't available in every country where Chubkins is offered.

By using the Service, you confirm that: (a) you are not located in, or ordinarily resident in, a country or region that is subject to comprehensive sanctions by the United States, the United Nations, the European Union or the United Kingdom, or that the U.S. Government has designated as "terrorist supporting"; and (b) you are not named on, or owned or controlled by anyone named on, any U.S. Government list of prohibited or restricted parties or any similar list kept by those authorities.

We may use your IP address, your app store country and other signals to work out where you are, and limit access to the Service, purchases or redemption based on your location. Don't use a VPN, proxy or other tool to hide your location or get around these limits. If you do, we may suspend your Account and cancel any pending redemption.

3.2 Changes to Terms#

We reserve the right to modify, amend, or otherwise change these Terms, in whole or in part, at any time and at our sole discretion. Such changes to the Terms will take effect as of the "Last updated" date stated at the beginning of these Terms.

Each time you access the Service, you agree to be bound by the most current version of the Terms. However, it is ultimately your responsibility to review the Terms for any changes before using the Service. You may not change any elements of the Terms without our prior written consent. By continuing to use the Service, you thereby consent to any and all updates to the Terms. If we make a material change, we'll tell you in the app or by email before it takes effect. If you don't agree to the change, stop using the Service and cancel any subscription before it renews.

3.3 Duration#

Upon any access or use of the Service, the Terms remain thereafter in full force and effect in respect of such access or use, as they may be updated from time to time.

4. USE OF THE SERVICE#

4.1 Limited License to Use the Service#

You may only use the Service as expressly permitted by these Terms. All rights not expressly granted to you are reserved by Chubkins, its third-party providers and other respective owners, if any.

Subject to all conditions, restrictions, and eligibility requirements described herein, we grant you a limited, non-transferrable, non-exclusive, royalty-free, worldwide, revocable license to access and use the Service for your own lawful, personal, and non-commercial purposes. This license is not a sale and does not grant any ownership right, title, interest, or any other rights in the Service.

If you breach any provision of these Terms, the above license will terminate automatically.

4.2 User Accounts#

(a) Account Registration

In order to access some features of the Service, you will have to create an account (an "Account"). You can play as a guest, or sign in with a one-time code sent to your email, with Google, or with Apple. A guest Account is tied to your device. If you delete the app or lose the device before you link the Account to an email, Google or Apple sign-in, you may lose your progress and items. Except as otherwise authorized by us, you may not have more than one Account or profile, nor may you apply to open an alternative account if your Account is suspended, restricted, or terminated for any reason.

When creating your Account you must provide accurate and complete information. By creating an Account, you give us and all users of the Service the ability and right to view your profile and any Content (as defined below) you share where other players can see it. Chat messages and photos you send are seen by the other player in that chat, and by our team when we review a report or investigate a violation of these Terms. You may never use another person's Account without permission. For more information regarding what we collect from you and how we use it, please consult the Privacy Policy.

(b) Responsibility for Your Account

You are solely responsible for your Account, login and profile. So long as you have an Account on the Service, you agree to safeguard your login credentials and to supervise and take full responsibility for any use of and activity on your Account by you or anyone other than you (whether authorized by you or not), which includes all content that can be linked or traced back to your Account, as well as any communications you have with other users.

You agree to immediately notify us of any unauthorized use of your Account, login, or profile and to report a lost or stolen Account to us at support@chubkins.app.

YOU ACKNOWLEDGE AND AGREE THAT: (1) NONE OF CHUBKINS OR ANY AFFILIATES OR PARTNERS WILL HAVE ANY LIABILITY TO YOU OR OTHERS FOR ANY UNAUTHORIZED TRANSACTIONS MADE USING YOUR ACCOUNT; AND (2) THE UNAUTHORIZED USE OF YOUR ACCOUNT OR LOGIN COULD CAUSE YOU TO INCUR LIABILITY TO ONE OR MORE OF CHUBKINS AND OTHER USERS OF THE SERVICE.

(c) Account Deletion

You can delete your Account at any time in the app, under Settings, or by submitting the Player Data Deletion Request form at https://forms.gle/PZffvJ9ykWYi2S5XA. Deletion is permanent and can't be undone. You lose your pets, progress, items, and any earned Diamonds you haven't redeemed. Account deletion does not refund purchases. Deleting your Account doesn't cancel a Care Pass subscription. A Care Pass subscription must be canceled in your Apple App Store or Google Play settings. Our Privacy Policy explains what we keep after deletion and for how long. Chubkins also reserves the right to terminate, restrict, or suspend your Account at any time with or without notice if we believe that you have breached these Terms, or for any other reason, with or without cause, at our sole discretion.

Chubkins is not required to disclose, and may be prohibited by law from disclosing, the reason for the termination or suspension of your Account. These Terms will survive termination of your Account.

(d) Effect of Account Suspension or Termination

If your Account is terminated or your access to the Service is restricted, you may continue using certain aspects of the Service (such as viewing only) without an account, and this Agreement will continue to apply to such use.

(e) Limited Commercial Use

You may NOT use any information obtained from the Service to advertise to, solicit, or sell to any other user. Chubkins may investigate and take any available legal action in response to illegal or unauthorized uses of the Service, including collecting information of users by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Service.

The Service and any marketing and other content viewed through our Service are for your personal and non-commercial use only. During your membership, we grant you a limited, non-exclusive, non-transferable right to access the Service and view the content through the Service. Except for the foregoing, no right, title or interest is transferred to you.

4.3 Restrictions on Your Use of the Service#

You agree that you will NOT use the Service, or any portion(s) thereof in any way not expressly permitted by these Terms or in any way that violates the governing law or any other applicable local, state, national and international laws and regulations of your residence and location; and that if you do, we reserve the right to terminate your access to and use of the Service, and you may be subject to various liabilities under the applicable laws. Specifically, you represent, warrant, and agree that you will NOT:

1. use the Service in a way that violates any law or infringes the rights of any person;
2. use the Service to sell access to the Service, gain advertising or subscription revenues, or collect, data-mine, or harvest personally identifiable information for your profit;
3. act as an agent, affiliate, or representative of Chubkins or the Service;
4. suggest or imply that Chubkins or the Service has any relationship or affiliation with any other company or services, or that Chubkins endorses, sponsors, or recommends the contents, products or services on any website, webpage, or other platform;
5. modify, translate, adapt, edit, transform, or otherwise create derivative works of or from any part of the Service;
6. circumvent, hack, disable, decompile, reverse-engineer, DDOS attack, password sniff, inject malicious code into, or interfere in any way with security-related features, robot-exclusion headers, technical measures, algorithms, source code, or digital rights management tools that restrict or limit use or copying of the Service;
7. impose, in our opinion, an unreasonable or disproportionately large burden on our infrastructure;
8. frame, mirror, or otherwise incorporate any part of the Service into any other website, webpage, mobile application, product, or service unless you have Chubkins's express permission to do so;
9. use bots, scripts, cheats, artificial intelligence, agents, or modified versions of the app or other automation, or exploit bugs, to play, earn Diamonds or complete missions;
10. create or use more than one Account to earn or redeem Diamonds, or sell, buy, trade or transfer Accounts, Diamonds or items outside the Service; or
11. hide your location, for example with a VPN, or give false information, such as a false date of birth, to get around age, country or redemption limits.

Additionally, you acknowledge and agree that you (and not Chubkins) are responsible for obtaining and maintaining all telecommunications, broadband, and computer hardware, equipment, software and services needed for you to access and use the Service, and for paying all charges related thereto.

4.4 Inviting Other Players#

You can invite people to Chubkins by text message, by sharing a link, or by choosing contacts from your phone. Only invite people you know who you think would want to hear from you. The invitation comes from you, and you're responsible for having their permission to contact them. We may give you a reward in the game when someone you invite joins or becomes your co-parent. The contacts you choose stay on your phone.

5. CONTENT#

5.1 Definition of Content#

"Content" here means any information available on or transmitted through the Service, including, without limitation, the following: ideas, data, text, tags, script, posts, messages, comments, questions, slogans, newsletters, descriptions, pricing, tables, statistics, rankings, ratings, reviews, lists, maps, spreadsheets, models, pictures, photographs, presentations, drawings, graphics, logos, designs, brands, images, buttons, icons, widgets, interfaces, applications, application programming interfaces, software, source code, object code, digital files, compilations, compositions, sounds, sound recordings, audio clips, music, jingles, spoken word, performances, speeches, audio-visual works, interactive works, games, video games, movies, films, shows, videos, video clips, commercials, infomercials, advertisements, and all other materials, features and functions available on or through the Website, or any other content through the Website that is copyrighted and/or trademarked work of Chubkins.

5.2 You are Responsible for Your Content#

You are solely responsible for the Content that you post, upload, publish, link to, transmit, record, display or otherwise make available (hereinafter, "Post") on the Service or transmit to other users whether publicly posted or privately transmitted.

You may not Post as part of the Service, or transmit to Chubkins or any other user (either on or off the Service), any offensive, inaccurate, incomplete, abusive, obscene, profane, threatening, intimidating, harassing, racially-offensive, sexually-explicit, or illegal material, or any material that infringes or violates another person's rights (including intellectual property rights, and rights of privacy and publicity).

5.3 Ownership and License of Your Content#

With respect to your original or proprietary Content that you Post or create on the Service, you will retain all rights, title, and ownership interests to that Content. In exchange for the valuable consideration of the opportunity to publish and share your Content with others through the Service, you hereby agree that Chubkins will automatically be granted a worldwide, perpetual, non-exclusive, sublicensable, transferrable and royalty-free license to that Content when it is first uploaded to or created on the Service.

You also grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access your Content through the Service, and to use that Content, including to reproduce, distribute, prepare derivative works, display, and perform it, only as enabled by a feature of the Service (such as video playback or embeds).

For clarity, this license does not grant any rights or permissions for a user to make use of your Content independent of the Service. If any of your Content is modified or deleted by you or by Chubkins, you understand that prior versions of such modified or deleted Content will continue to be licensed to and freely used by Chubkins in such earlier form, and may persist in backup copies for a reasonable period of time (but that following modification or removal, we will not make them available publicly on the Service) or may remain with users who have previously accessed and downloaded such prior versions of your modified or deleted Content.

You also hereby grant Chubkins a worldwide, perpetual, non-exclusive, sublicenseable, transferrable and royalty-free license to use your name, profile information, biography, photograph, and likeness in connection with such Content. You acknowledge that we may choose to use and reuse the Content in any way, with or without attribution, and at our sole discretion.

5.4 Changes and Other Uses of Content#

You agree that this license also includes the right for Chubkins to make your Content available to others for the publication, display, distribution, transmission, performance, syndication, or broadcast through any media and online platforms. Such additional uses by Chubkins or others may be made with no monetary or other compensation. We may modify, adapt, or create derivative works from your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.

5.5 Monitoring and Takedown of Your Content#

You understand and agree that Chubkins may, but is not obligated to, monitor or review any Content Posted on the Service. We use automatic filters that block things like contact details, links, phone numbers and banned words in chat and in player and pet names, and our team reviews reported messages and photos. Chubkins may also delete any Content, in whole or in part, that in the sole judgment of Chubkins violates these Terms or may harm the reputation of the Service or Chubkins.

5.6 Other Users' Content#

Please use caution and common sense when using other users' Content you may find on the Service. It is possible that you may be of the opinion that Content originating from other users on the Service is offensive, harmful, inaccurate, or deceptive to you. You understand and agree that you may only use the Service at your own risk and that you will not seek to hold us liable in any manner for Content provided or created by other users.

5.7 Conduct of Other Users#

Chubkins is not responsible for your conduct or the conduct of any other user of the Service. You are solely responsible for your interactions with other users. We don't run background checks on users. In no event will Chubkins, our affiliates, partners, or agents be liable (directly or indirectly) for any losses or damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service including, without limitation, death, bodily injury, emotional distress, and/or any other damages.

5.8 Content of Chubkins or Our Affiliates#

We reserve the right to change or remove all Content from the Website for any reason and without notice to you. You may NOT reproduce Content found on the Website (except for Content that you Post) in other websites or platforms without obtaining our prior written consent.

6. ELECTRONIC COMMUNICATIONS#

This section does not apply to information that you supply to the Service that can identify you personally. Chubkins believes in protecting your privacy. Please visit our current https://chubkins.app/privacy which also governs your use of the Service, to understand our practices.

If you send or transmit any communication, including but not limited to feedback, questions, comments or suggestions to Chubkins, whether by letter, email, telephone, through the contact form on our Website, or otherwise (collectively, "Feedback"), all such Feedback is, and will be treated as non-confidential and non-proprietary.

You hereby assign to Chubkins all right, title, and interest in, and Chubkins is free to use, without any attribution or compensation to you, any ideas, concepts, know-how or techniques or other intellectual property and proprietary rights contained in the Feedback, whether or not patentable, for any purpose whatsoever, including but not limited to enhancing the Service, or otherwise developing, manufacturing, licensing, marketing and selling products and services based on or containing such Feedback.

7. LINKS#

7.1 Links to Third-Party Websites#

The Service may contain links and advertisements to other websites, webpages, smartphone applications, services, products, and other resources. Chubkins has no control over such third party websites or resources, and you acknowledge and agree that we are not responsible for the availability of such websites, webpages, services, products, or resources, and do not endorse and are not responsible or liable for any information, content, advertising, products, or other materials on or available therefrom.

You also acknowledge and agree that Chubkins will not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or resource. Moreover, your correspondence and business dealings with other third parties found on or through the Service, including payment and delivery of any advertised goods or services—and any other terms, conditions, warranties or representations associated with such dealings—are solely between you and such other user or third party. This includes ads, missions and offers from third parties, and gift cards you choose at bitrefill.com (see the Rewards Program Terms). You agree that Chubkins shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such users or other third parties on our Website.

7.2 Links From Third-Party Websites to Chubkins Website#

Unless we provide you with written consent giving you broader rights to link or advertise the Service on third party websites, you may only link or hyperlink to the Service elsewhere on the Internet and World Wide Web for non-commercial purposes. In doing so, you may NOT use any of our trademarks or trade names except in a plainly descriptive manner.

You may link to the Service only in compliance with these Terms, and only in the following instances:

• The link does not reproduce the Content, totally or partially, in any way;
• The link does not contain false, inaccurate or incorrect statements about Chubkins or the Service;
• The look and feel of all Content that accompanies the link shall not otherwise be of a nature that may damage or dilute the goodwill associated with Chubkins' name, reputation or any of its trademarks;
• The third-party websites or resources where you link the Service do not contain or promote illicit, illegal, vulgar, obscene, sexual, erotic, pornographic, degrading, or otherwise inappropriate Content.

We may revoke our consent to a link at any time, without prior notice. If we notify you that you may no longer link to the Service, or to a page or document, you must promptly (and, in any event, within three business days) remove all affected links from your website.

8. INTELLECTUAL PROPERTY RIGHTS#

Any trademarks and service marks, trade names, trade dresses, copyrighted works of authorship, rights of publicity, patents, know-how, trade secrets, and proprietary ideas that are displayed, performed, transmitted, or otherwise appearing on the Service (collectively, the "IP") are owned by Chubkins, licensed to Chubkins, or used by Chubkins in a merely descriptive manner, under the fair use doctrine, under the first-sale doctrine, by virtue of being in the public domain, or in accordance with another legal exception or exemption.

Other than as expressly allowed by us in writing, nothing herein or in the Service may be implied as granting any license, assignment, or right to copy or use of our trade name or any of our IP without our prior written authorization. Any unauthorized reproduction or distribution of the Service or Content that you do not own, or parts thereof, is expressly prohibited and may result in civil litigation, damages, injunctive relief and possibly even criminal penalties under law.

9. REWARD AND PAYMENT SYSTEMS#

9.1 Diamonds and Other Rewards#

Chubkins may let you earn or obtain Diamonds, coins, virtual items, points, or other in-app rewards (collectively, "Rewards") by playing the App, completing tasks or missions, or through promotional activities.

License Only. Rewards are licensed, not sold. We may manage, regulate, modify, or remove Rewards (including balances) at any time for gameplay, technical, or policy reasons. Earning methods, rates, caps, and eligible redemptions may change, as described in the Rewards Program Terms for redemption. We may run limited-time promotions that award bonus Rewards subject to posted terms.

Diamonds and items you buy don't expire. Earned Diamonds and other free Rewards may expire if you don't sign in to Chubkins for 6 months in a row. Where the law requires it, we'll give you up to 30 days' notice before they expire. We may also close an Account after 18 months without a sign-in, and any Rewards left in it are then lost. Some free event items may be available only for a limited time, as shown in the app. We may reverse or adjust Rewards for suspected fraud, abuse, errors, or chargebacks. Botting, exploiting bugs, multi-accounting, or trading Rewards/accounts is prohibited and may lead to loss of Rewards and/or account actions.

Rewards, including Diamonds, have no cash value, aren't money, and can't be exchanged for cash. The only exception is the Chubkins Rewards Program, which lets you redeem earned Diamonds for gift cards (store credit) under the Rewards Program Terms at the end of this page. Rewards are a limited license to digital content and are not unclaimed property.

Certain third-party ad views, missions or offers may grant Rewards when the network confirms completion. Third-party terms may apply; incomplete/invalid engagements won't earn Rewards.

9.2 In-App Purchases (IAP)#

Purchases are processed by Apple (App Store) or Google (Google Play) (not Petoskey), and their terms of sale also apply. We may change prices, bundles, availability, and eligibility at any time. Prices may vary by region/tax.

Chargebacks/Fraud. We may suspend or remove items/Rewards or take account action for chargebacks, suspected fraud, or policy violations. Except as required by law or store policy, IAP are final and non-refundable. Refund requests go to Apple or Google under their policies; we can't issue refunds for store purchases ourselves.

You may cancel your Account at any time; however, there are no refunds for cancellation. In the event that Chubkins suspends or terminates your Account or this Agreement, you understand and agree that you shall receive no refund or exchange for any unused time on a subscription, any license or subscription fees for any portion of the Service, any content or data associated with your Account, or for anything else.

Delivery. Virtual items/IAP are delivered to your account upon store confirmation. Delivery may be delayed by connectivity or platform issues. If a purchase doesn't arrive, use Restore Purchases in the app or contact support@chubkins.app.

Some items, such as Eggs, give a random result. Section 9.6 shows the odds.

9.3 Taxes & Compliance#

You are responsible for any taxes arising from your IAP or use of the App, except where the app store collects/remits at checkout. Section 2.1 sets the minimum age, and Section 3.1 explains where Chubkins and its features are available.

9.4 Changes and Termination#

We may change, suspend, or discontinue the Rewards Program or IAP features (including specific items, accrual/redemption rules, and balances) at any time. Where required, we will provide notice in-App. If the service ends, unused Rewards and unredeemed virtual items may expire. If we end the Rewards Program, we'll give at least 30 days' notice in the app so you can redeem the earned Diamonds you have, unless the law, a gift card provider or fraud prevention requires us to stop sooner.

9.5 California Residents#

If you are a California resident, in accordance with Cal. Civ. Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254. You may also contact us with complaints or to receive further information at support@chubkins.app.

9.6 Randomized Virtual Items — Odds Disclosure#

Certain items in Chubkins ("Eggs") yield a randomized virtual pet when hatched. Pets are classified into four rarities of increasing scarcity: Common, Rare, Legendary, and Eternal. Every hatch produces exactly one pet. The probability of hatching a pet of each rarity, per single hatch, is:

Odds are identical whether an Egg is obtained for free or purchased, and are applied independently to each hatch. Each 10-hatch bundle of the Rare, Legendary, and Eternal Eggs additionally guarantees at least one pet of Rare-or-higher, Legendary-or-higher, and Eternal rarity respectively. The rates above are base probabilities; in-game "pity" and guarantee mechanics can only increase the chance of higher-rarity outcomes, never decrease it. Published odds are subject to change; the current odds are always viewable in-game prior to each hatch. If we change the base odds, we'll update this section and the odds shown in the game before the change takes effect.

Featured events. During a limited-time featured event, the featured Egg has a higher chance of hatching the featured pet than the base rates above. When you hatch a pet of the featured pet's rarity, there's a 50% chance it's the featured pet, and if it isn't, the next one of that rarity is guaranteed to be the featured pet. Each event shows its exact odds in the game before you hatch.

9.7 Subscriptions (Care Pass and Duo Pass)#

Care Pass is a subscription that renews automatically, monthly or yearly. Before you subscribe, the app shows the price, the billing period and what's included. Some offers start with an introductory price or a free trial. When the offer ends, the subscription continues at the regular price unless you cancel at least 24 hours before it ends.

Your subscription renews automatically at the end of each billing period, and you're charged through your Apple or Google account, unless you cancel at least 24 hours before the period ends. You can cancel at any time in the app, from the Care Pass screen, or in your App Store or Google Play subscription settings. When you cancel, the subscription stops renewing, and you keep Care Pass until the end of the period you've paid for. Deleting the app or your Account does not cancel your subscription.

Refunds are handled by Apple or Google under their policies. If we raise the price, we'll tell you before it takes effect, and Apple or Google will ask for your consent where required. A subscription belongs to the Apple or Google account that bought it. Restore Purchases brings it back on a new device, but it doesn't move it to a different Chubkins Account.

Duo Pass, when it's offered, is a version of Care Pass that the buyer shares with one co-parent of a pet they raise together. The co-parent is covered only while the buyer's subscription is active. If the buyer cancels, or the subscription lapses or is refunded, the co-parent's cover ends at the same time, though they keep the rewards they already received. The buyer can move the shared seat to a different co-parent once every 30 days.

10. INDEMNIFICATION#

You agree to defend, indemnify, reimburse, and hold harmless Chubkins as well as its shareholders, officers, employees, agents, advisors, subsidiaries, affiliates, assignors and licensors from and against any and all claims, causes of action, actions, demands, liabilities, damages, losses, fines, penalties, costs and expenses of any kind, and settlements including without limitation, attorney, paralegal, expert witness, investigation, and accounting fees, arising out of, relating to or in connection with:

• your use (or misuse) of and access to the Service,
• your breach of any provision in these Terms,
• any of your representations or warranties made herein,
• your violation of any applicable law, rule or regulation, or rights of any third party,
• any claim that any information that you provide to Chubkins in connection with the Service, including the Content you Post, caused damage to, infringed upon, misappropriated or otherwise violated the rights of any third party,
• any dispute that you have with any third party relating to or in connection with the Service.

We will have the option to assume the exclusive defense and control of any action to which Chubkins is named a party, and you agree to cooperate with us in asserting any available defenses we find appropriate.

11. DISCLAIMERS AND LIMITATION OF LIABILITY#

THE WEBSITE AND THE CONTENT PUBLISHED WITHIN THE WEBSITE MAY INCLUDE INACCURACIES OR ERRORS. CHUBKINS DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, TIMELINESS, SECURITY, AVAILABILITY OR INTEGRITY OF THE SERVICE, AND DISCLAIMS ALL LIABILITY FOR ANY ERRORS OR OTHER INACCURACIES RELATING TO THE SERVICE.

Chubkins makes no representations about the suitability of the Service, or that the Service will be uninterrupted or operate in combination with any software, service, system or other data or information. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

Chubkins disclaims all warranties and conditions that this Service, its servers, or any email sent from Chubkins, are free of viruses or other harmful components.

Chubkins hereby disclaims all warranties and conditions with regard to the Service, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and noninfringement. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, THE FOREGOING DISCLAIMER MAY, IN WHOLE OR IN PART, NOT APPLY TO YOU.

To the maximum extent permitted by applicable law, Chubkins assumes no liability or responsibility for any (I) errors, mistakes, or inaccuracies of any content; (II) personal injury, death or property damage, of any nature whatsoever, resulting from your access to or use of the Service; (III) any unauthorized access to or use of our servers and/or any and all information stored therein; (IV) any interruption or cessation of transmission to or from the Service; (V) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (VI) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available through the Service; and/or (VII) the defamatory, offensive, or illegal conduct of any user, creator or third party.

IN NO EVENT SHALL CHUBKINS (AND ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, AND AFFILIATES) BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OR DAMAGES FOR LOST PROFITS, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, YOUR ACCESS TO OR USE OF THE SERVICE OR WITH THE DELAY OR INABILITY TO ACCESS, DISPLAY, OR USE THE SERVICE; ANY COMPUTER VIRUSES, INFORMATION, SOFTWARE, LINKED SERVICES, PRODUCTS, AND SERVICES OBTAINED THROUGH THE SERVICE; OR OTHERWISE ARISING OUT OF THE ACCESS TO OR USE OF THE SERVICE WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF CHUBKINS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL CHUBKINS (AND ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, AND AFFILIATES) BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN EXCESS OF THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) US $100. THE LIMITATION OF LIABILITY REFLECTS THE ALLOCATION OF RISK BETWEEN THE PARTIES. THE LIMITATIONS SPECIFIED IN THIS SECTION WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY RIGHT OR REMEDY YOU HAVE UNDER CONSUMER PROTECTION LAWS THAT CAN'T BE EXCLUDED OR LIMITED BY CONTRACT, SUCH AS THE CONSUMER GUARANTEES UNDER THE AUSTRALIAN CONSUMER LAW OR NEW ZEALAND'S CONSUMER GUARANTEES ACT 1993. WHERE THOSE LAWS LET US LIMIT OUR LIABILITY FOR FAILING TO MEET A GUARANTEE, OUR LIABILITY IS LIMITED TO SUPPLYING THE SERVICE AGAIN OR PAYING THE COST OF HAVING IT SUPPLIED AGAIN.

12. MODIFICATION OF THE SERVICE#

Chubkins may, at any time and in Chubkins' sole discretion, modify, suspend or discontinue the Service without notice, for any reason. We shall have no liability to you or to any third party for any such modification, suspension or discontinuance.

13. ENFORCEMENT#

The remedies available to Chubkins in these Terms are cumulative and in addition to any others available to Chubkins. Chubkins may seek all remedies available to it at law and in equity for any violation of these Terms. Chubkins may suspend, terminate or block your access to the Service (in whole or in part) for any violation or suspected violation as we determine, without notice to you.

Your violation of these Terms shall be considered a breach of contract. We reserve the right, but do not assume any obligation, to investigate any suspected violation of these Terms or any misuse of the Service.

In addition, we further reserve the right to report any activity, data or persons to, and otherwise cooperate with: (i) law enforcement authorities; (ii) system administrators at Internet service providers, networks or computing facilities; and (iii) providers and/or third-party vendors if we suspect that you have violated these Terms or any law, rule or regulation. You acknowledge that such reporting or cooperation may include, without limitation, providing information relating to you and/or your use of the Service, including, without limitation, your email address, IP address or other identifying information, to law enforcement authorities, financial regulators, third-party providers, vendors or system administrators. Further, we may disclose any information we think necessary to comply with applicable law, regulation, subpoena or other legal process or governmental or regulatory request.

14. DISPUTE RESOLUTION SYSTEM#

14.1 Governing Law#

These Terms and any and all claims, disputes or other legal proceedings by or between you and us, including but not limited to any claims or disputes that are in any way related to or arising out of these Terms or your use of or access to the Service, shall be governed by and construed in accordance with U.S. federal law and the laws of Delaware, without regard to any principles of conflicts of law. If you live outside the United States, this choice of law doesn't take away the protection of mandatory consumer laws of the country where you live.

14.2 Arbitration (United States Only)#

This Section 14.2 applies only if you live in the United States.

Before starting arbitration, email support@chubkins.app with a description of your claim and give us 30 days to try to resolve it informally. Either of us may bring an individual claim in small claims court instead of arbitration.

ALL DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR ANY ASPECT OF THE RELATIONSHIP BETWEEN YOU AND CHUBKINS, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL ARBITRATOR. YOU AGREE THAT ANY ARBITRATION UNDER THIS AGREEMENT WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION.

The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator will conduct hearings, if any, by teleconference or videoconference, rather than by personal appearances, unless the arbitrator determines upon request by you or by us that an in-person hearing is appropriate. Any in-person appearances will be held in Delaware, United States, unless you and Chubkins otherwise agree in writing.

If you live outside the United States, this Section 14.2 doesn't apply to you. Disputes will be decided by the state or federal courts located in Delaware, unless the law of the country where you live gives you the right to bring the claim in your local courts.

14.3 Irreparable Harm#

Notwithstanding Section 14.2, you acknowledge that unauthorized use of the Service or other breach of these Terms could result in immediate and irremediable damage to Chubkins, and that money damages alone would be inadequate to compensate Chubkins. Therefore, in the event of your breach or threatened breach of any provision of these Terms, Chubkins may, in addition to all other remedies, immediately obtain and enforce injunctive relief prohibiting the breach or compelling specific performance.

15. GENERAL PROVISIONS#

15.1 Relationship of the Parties#

No agency, partnership, joint venture, or employment relationship is created or exists between you and Chubkins or our affiliates unless expressly stated in another agreement.

15.2 Waivers#

The failure of either party to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder. For any waiver of compliance with these Terms to be binding, we must provide you with written notice of such waiver through one of our authorized representatives.

15.3 Entire Agreement#

These Terms constitute the full agreement in respect of your use of the Service, and supersede any other communication, understanding or agreement between you and Chubkins concerning the Service.

15.4 Severability#

If any provision of these Terms is deemed to be unenforceable or invalid by any court or arbitrator of competent jurisdiction, for any reason, that provision will be limited or severed to the extent necessary so that these Terms will otherwise remain in full force and effect.

15.5 Assignments#

You may not assign or transfer the Terms or any licenses and rights discussed herein. Any attempt by you to assign, transfer, delegate or sublicense the Terms, or any part thereof, without such consent will be null and void. We may assign, transfer, delegate or sublicense the Terms or any licenses and rights discussed herein, at our sole discretion, without restriction.

15.6 Notices#

All notices we are required to give you may be delivered electronically by email or through the Website. Unless you indicate otherwise prior to our sending of the notice, we may send email notices to your last-supplied email address. Notices we send you will be deemed delivered when emailed or otherwise transmitted by us.

15.7 All Rights Reserved#

All rights not expressly granted to you herein are reserved and not waived. We reserve the right to enforce our rights to the fullest extent permitted under the laws of any relevant jurisdiction, including criminal prosecution where available.

15.8 Apple App Store#

This section applies if you got the Chubkins app from the Apple App Store.

1. These Terms are between you and Chubkins only, not Apple. Chubkins, not Apple, is solely responsible for the app and its content.
2. Your license to use the app is non-transferable and limited to Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be used by other accounts associated with you through Family Sharing or volume purchasing.
3. Chubkins is solely responsible for any maintenance and support of the app, as these Terms or the law require. Apple has no obligation to provide any maintenance or support for the app.
4. Chubkins is solely responsible for any product warranties, whether express or implied by law, to the extent they aren't effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are Chubkins' responsibility.
5. Chubkins, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
6. If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, Chubkins, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
7. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Questions, complaints and claims about the app go to Chubkins, using the contact details in Section 16.
9. You must comply with any third-party terms that apply when you use the app, such as your mobile data plan.
10. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

15.9 Google Play#

If you got the Chubkins app from Google Play, Google Play's terms of service also apply to your download and purchases. Google is not a party to these Terms and isn't responsible for the app.

Chubkins Rewards Program Terms#

These Program Terms apply to redeeming Diamonds for gift cards in Chubkins. They are part of the Chubkins Terms of Use above. Chubkins is run by Petoskey Gaming Company, LLC ("we", "us").

1. Who can redeem#

You must be 18 or older, or the age of majority where you live if that is higher, and live in a country where Chubkins is available and redemption is offered. Redemption isn't offered in every country where the game is available. Before your first redemption, you must enter your date of birth. You can't change it afterwards, so make sure it's correct. Redemption is not available to anyone located in a sanctioned country or named on a sanctions list. We may ask you to verify your identity, age or location before a redemption, for example with a photo ID or a selfie. If you don't, or the check fails, we may hold or cancel the redemption.

2. Earned Diamonds#

Only earned Diamonds can be redeemed. You get earned Diamonds only by completing missions in the game. Some missions give Diamonds back when you make an in-game purchase. Those missions say so before you start, and the Diamonds they pay count as earned. Earned Diamonds are never awarded by chance or based on how well you play.

All other Diamonds are for in-game use only and can never be redeemed. That includes Diamonds you buy in the Shop and Diamonds the game gives you, for example from rewarded ads, tasks, chests, level-ups, Care Pass and invites. No Diamonds can be bought, sold or traded between players.

When you spend Diamonds in the game, your other Diamonds are used first and your earned Diamonds last.

3. Redemption rate#

75 Diamonds = $1 gift card (USD).

Gift cards come in fixed amounts, starting at $10, and are subject to availability. The brands you can choose depend on your country, and some brands may not be offered at all. The rate and the amounts are always shown on the Redeem screen. If they change, we will update them there and on this page before the change takes effect.

4. Limits#

You can redeem up to $20 in gift cards per day and $550 per year. Limits apply per person, across all accounts.

5. What you receive#

You receive a Bitrefill gift card code by email, and you choose the gift card you want at bitrefill.com. Bitrefill may require you to create an account. The code can only be used on bitrefill.com. It is non-refundable, cannot be exchanged for cash and cannot be resold.

The gift cards available depend on your country. Cards are meant for use in your own country: a card from another country may not work, and using a VPN or similar tool to get cards from another country breaks Bitrefill's terms.

Gift cards are distributed by Petoskey Gaming Company, LLC as a non-exclusive distributor of Bitrefill. They are provided by Bitrefill and created and issued by third parties, whose own terms may apply. Your use of Bitrefill is governed by the Bitrefill Terms (https://www.bitrefill.com/terms/) and Bitrefill Privacy Policy (https://www.bitrefill.com/privacy/).

Gift cards are store credit, not cash.

6. If something goes wrong#

If a gift card cannot be issued, your Diamonds go back to your earned balance. Once a code has been delivered, the redemption is final and cannot be reversed or refunded. Keep your code safe. If there is a problem with your code, contact support@chubkins.app within 30 days of receiving it.

7. No cash value#

Diamonds have no cash value. They are not money, cannot be exchanged for cash, and can only be redeemed for gift cards under these Program Terms.

8. Taxes#

You are responsible for any taxes that apply to gift cards you receive.

9. Fair play#

We may hold, reverse or cancel a redemption if we suspect any of the following:

• fraud
• bots
• multiple accounts
• exploiting bugs and/or game design
• a chargeback
• hiding your location, for example with a VPN
• a false date of birth or other false information

In those cases we may also remove the Diamonds involved and close the account.

10. Deleting your account#

If you delete your account, any earned Diamonds you have not redeemed are lost and cannot be restored. Earned Diamonds also expire if you don't sign in for 6 months in a row, and we may close an account after 18 months without a sign-in (section 9.1 of the Terms of Use).

11. Sponsors#

The merchants shown are not sponsors of Chubkins or otherwise affiliated with us. Logos are trademarks of their owners. Apple and Google are not sponsors of this program and are not involved in it in any way.

12. Changes#

We may change or end the program at any time, as described in section 9.4 of the Terms of Use. If we end it, we'll give at least 30 days' notice in the app so you can redeem your earned Diamonds first.
